Will a BUI Affect Your Auto Insurance Rate?

Posted by Allison Ruuska on 6/2/2008 at 1:00 PM

If you're caught operating a boat under the influence and receive a BUI, will it affect what you pay for auto insurance?

You may know it's possible to receive a DUI or DWI while driving a car, but did you know that you can receive a BUI for operating a boat under the influence? It's true. In fact, regardless of what state you live in, it's illegal to operate a boat under the influence of alcohol or drugs. The consequence of doing so is a BUI, or Boating Under the Influence.

States Determine Boat Operation Rules

While operating a boat under the influence is illegal in all states, the consequences may vary from state to state. In fact, a BUI could cause your auto insurance rate to increase in some states. However, in other states, a BUI may not affect what you pay for auto insurance.

To find out how your state treats BUIs in relation to auto insurance, contact your state's Department of Insurance, or call your insurance company to see what state regulations exist.

How Long Can a BUI Affect You?

If you determine that a BUI could affect your auto insurance rate, you should also find out how long it could stay on your record. This is determined by your insurance company rather than by state legislation.

Some companies may consider a BUI for three years, while others may choose to drop it from your insurance rates after a longer period of time. Contacting your insurance company is the best way to find out how it treats a BUI.

Is an SR-22 Required for a BUI?

You may wonder if you need to file an SR-22 after receiving a BUI. The short answer is no. In most states, boat insurance isn't required, so you don't have to file an SR-22 because of a BUI.

Although some states do require boat insurance, you most likely won't need to file an SR-22 in those states. However, because laws can change, make sure you check with your insurance company or your state's Department of Insurance for the latest requirements.

What to Do If You Receive a BUI

Even if you weren't involved in an accident when you receive a BUI, you may still be required to contact your boat insurance company if you receive one.

Remember that with boat insurance, you're paying your insurance company to protect you in situations that involve damage to other people or property and to yourself and your boat if you choose more than liability coverage. However, remember that if you're involved in an accident and you're cited for a BUI, your insurance company will only provide coverage and protection if your accident falls within your policy guidelines.

Obviously, you should never operate a boat if you've been drinking or are under the influence of drugs. But, if you're in an accident and cited for BUI, your boat insurance may still provide you with protection. Be sure to check with your boat insurance company for details.
