PROGRESSIVE CASUALTY INSURANCE COMPANY SIGN-UP CONTEST (“Contest”)
RULES (the “Rules”)
NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE.
A PURCHASE or payment WILL NOT INCREASE AN ENTRANT’s CHANCES OF WINNING.
The Safe Travels Distracted Driving Reduction Contest is sponsored by Progressive Casualty Insurance Company (the “Sponsor” or “Progressive”).
1. ELIGIBILITY:
The Contest is available only to those persons, 17 years of age or older (at the time of entry), who are legal residents of the United States or the District of Columbia, and who are licensed drivers. Each participant, in order to be eligible for the Contest, must use the Progressive Safe Travels app, made available to participant free of any charge or cost, and more fully described in Exhibit A. If the Contest is open to minors, a parent or guardian of any participant who is a minor must sign a release on behalf of the minor to be eligible to receive a Prize. Participants under eighteen (18) years of age who are eligible to participate in the Contest must obtain the consent of the participant’s parent(s) or legal guardian prior to participating in the Contest. The Sponsor may require an indemnity in such form within such time from such parent(s) or legal guardian before such participant may claim a Prize.
Employees of Sponsor and any company or entity providing any Prize to be awarded in connection with the Contest (each a “Prize Provider”) and any of their respective owners, parent companies, affiliates, directors, subsidiaries, franchisees, representatives, employees, directors, officers, advertising, promotion and production agencies, agents (collectively “Released Parties”) and their immediate family members of any of the above (meaning spouses, parents, siblings and children living in the same household) and/or those living in the same household (whether related or not) are not eligible to enter or win.
2. PROMOTION PERIOD: The Contest consists of a driver challenge to reduce distracted driving that shall take place during each Contest Period. The Contest will consist of ten (10) individual weekly Contest Periods. Each weekly Contest Period will begin at a specified time and will end at a specified time as detailed in the chart below.

3. HOW TO ENTER THE CONTEST: On or before the beginning of the weekly Contest Period, an eligible entrant must logon to the Safe Travels app and enter the Contest as set forth below:
Online Entry ─ On or before the beginning of the weekly Contest Period, you must first register and create an Account as described in the Safe Travels Terms of Use, which Terms of Use are incorporated herein by reference. Upon registration, you will receive one (1) entry into the Contest to earn spins (as detailed below) for a chance to win Prizes. Entrants must provide all information requested to be eligible to win. Incomplete, unreadable, or unintelligible entries, in the sole discretion of Sponsor, will be disqualified. Sponsor will not verify receipt of entries. All entries submitted become the sole property of Sponsor and will not be acknowledged or returned.
4. Guidelines and Restrictions:
Entry is limited to one (1) entry per person. If it is discovered that any person has attempted to: (a) obtain more than one (1) entry per person and/or (b) use (or attempt to use) multiple names, identities and/or more than one (1) email address to enter the Contest; then (in the sole and absolute discretion of the Sponsor) he/she may be disqualified from the Contest.
Each entrant represents and warrants that his/her entry conforms to these Rules and understands that Sponsor, in its sole discretion, may disqualify the entry for any reason, including if it determines, in its sole discretion, that the entry fails to conform to these Rules in any way as determined by Sponsor, in its sole discretion. Any use of programmed, automatic or scripted entry methods will void all associated entries and individuals using such methods may be disqualified for future entry opportunity.
5. CONTEST AWARD: During the Contest Period, Sponsor will calculate the distraction-free minutes of driving for all entrants and entrants will be able to earn spins for a chance to win Prizes in one of two ways. When an entrant invites a friend to utilize the Safe Travels app both the entrant and such friend will each receive one free spin when such friend enters the entrant’s invite code during registration; and/or when an entrant accumulates 300 distraction-free minutes of driving. Entrants exercise a spin by spinning the wheel in the Safe Travels app. An entrant can’t earn more than 1,000 distraction-free minutes in a week and spins expire 30 days after they are earned. Sponsor utilizes “time-based seeding” to determine which spins win. Time-based seeding distributes Prizes throughout the Contest Period by randomly assigning a Prize to certain times (e.g. 5/1/17 10:03 am Eastern). The first spin to occur after the identified time wins that particular Prize and in the case that no entrant claims a particular Prize before the next identified time is selected, the unclaimed Prize will accumulate in the Prize pool until it is either depleted or withdrawn from the Prize pool at the end of the Contest Period. Notwithstanding the foregoing, each entrant selected is deemed a potential winner pending confirmation and/or verification of the entrant’s eligibility and compliance with the Rules as determined by Sponsor.
6. CONTEST PRIZES:
A total of 1,000 Prizes may be awarded during each Contest Period consisting each of: a Gift Card in the amount of five dollars ($5).
Prizes are subject to additional terms and conditions as set forth below.
7. TOTAL APPROXIMATE RETAIL VALUE ("ARV") OF ALL PRIZES IN EACH CONTEST PERIOD IS $5000.
8. PRIZE ACCEPTANCE:
The most recent spin winner is displayed for all entrants to see on the Spin to Win screen of the Safe Travels app. The winners will be notified via the Safe Travels app and can redeem his/her Prize online via the Sponsor's rewards fulfillment partner. By accepting a Prize, each winner hereby agrees to the terms and conditions set forth in Exhibit B. In the event of noncompliance with such terms and conditions, and/or if a winner cannot be reached at the email address on that winner's entry, and/or if a Prize notification is returned as unclaimed or undeliverable, that Prize will be forfeited and an alternate winner will be selected by the method described above. No substitution of any Prizes will be offered. No Prize transfer permitted. All taxes, fees, and surcharges on Prizes are the sole responsibility of the Prize winner. All expenses are the responsibility of the Prize winner. The winner may be required to furnish proof of identification and other proof of eligibility under these Rules.
Acceptance of a Prize will constitute permission to use winner’s name, photo(s), hometown, likeness, statements or Prize information for advertising and publicity purposes worldwide in connection with the Contest without limitation and without additional compensation, except where prohibited.
The Released Parties will not be responsible for any and all claims of any kind to or of any person or property (including, without limitation, death of any person), arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a Prize, participation in any Contest related activity, or participation in this Contest.
9. GENERAL CONDITIONS:
All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Ohio. All claims relating to the Contest must be resolved in the state or federal courts located in Cleveland, OH. All federal, state, and local laws and regulations apply. Void where prohibited by law.
All entry materials become property of Sponsor and will not be returned. By entering, the entrant agrees to the use of his/her name, address, photograph, videotape, or any likeness for advertising or publicity purposes and to the use of statements made by or attributed to the entrant relating to Sponsor or to this promotion and releases any and all rights to said use without further compensation.
If it is discovered that an entrant has registered or attempted to register more than once using multiple e-mail addresses, telephone numbers or multiple identities, all of the entrant's entries will be declared null and void and any Prize an entrant might have been entitled to will not be awarded.
Sponsor, its agents, directors, officers, employees, representatives, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (a) electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, server malfunction, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions or any human, mechanical or technical or electronic error which may occur in the collection and processing of entries; (b) failed, incomplete, garbled or delayed computer and/or electronic transmissions; (c) lost, late, misdirected or incomplete entries or personal information or mail; (d) any condition caused by events that may cause the Contest to be disrupted or corrupted, regardless of the reason; (e) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible, or postage-due entries; (f) any injuries, losses, or damages of any kind arising in connection with or as a result of the Prize, or acceptance, possession, or use of the Prize, or from participation in the Contest; or (g) any printing or typographical errors in any materials associated with the Contest.
In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Sponsor's control, which corrupt the integrity, administration, security or proper operation of the Contest, Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend the Contest.
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, the terms and conditions of these Rules shall prevail, govern and control.
Please review Sponsor's PRIVACY POLICY. By participating in the Contest, entrants agree to all of the terms and conditions of this privacy policy of the Sponsor. By entering, entrants agree to be bound by these Rules, and by the decisions of Sponsor (and/or its designated representatives) with respect to all aspects of this Contest, which are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entrants and/or entries.
10. PRIZE WINNERS' LIST: For a list of prize winners, send a self-addressed, stamped envelope to: Progressive Casualty Insurance Company, Safe Travels Program, 300 North Commons Blvd., Mayfield Village, OH 44143. All requests must be received by June 30, 2018.

This Contest is in no way sponsored, endorsed or administered by, or associated with Apple Inc., Google Inc., Facebook, Inc. and/or any Prize Provider. Each Entrant understands that he/she is providing his/her information to the Sponsor only. The information the entrant provides will only be used for the administration of this Contest and in accordance with the Sponsor's privacy policy. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor via postal-service mail to Sponsor's address set forth above.

Exhibit A
Safe Travels is a FREE app that helps you kick distracted driving and have fun doing it. Invite your friends, compete to be the safest driver, and earn spins for a chance to win gift cards.
The Safe Travels app automatically captures trips to identify when you're driving (vs. a passenger) and breaks down your distraction (i.e. phone usage while driving) at a level of detail you can easily understand: such as typing & swiping, handheld calls, and hands-free calls. The app also uses competitions, rewards, and nudges - to help you reduce your distracted driving and ultimately see who's the best driver.
Exhibit B
The winner has complied fully with all of the Rules of the Contest, and has met the eligibility requirements specified in the Rules, and the winner agrees to comply with all of the requirements of the Contest as interpreted by Sponsor.
The winner agrees to and hereby releases, discharges, indemnifies and holds harmless, on behalf of the winner's assigns, personal representatives and heirs, the Sponsor and its respective parent companies, subsidiaries, affiliates, owners, members, directors, employees, officers, representatives, licensors, advertising, promotion and production agencies, agents production partners, advertising agencies, promotional suppliers, participating vendors or any other company involved in the design, production, execution or distribution of this Contest (collectively, the “Released Entities”) from and against any and all liability, claims, damages, demands, causes of action, costs and expenses (including reasonable attorneys' fees) that the winner may have now and in the future, no matter how caused, arising out of, or in connection with the Contest, preparation for and participation in the Contest, including without limitation, liability for personal injury, damage or loss, associated with any Prize awarded or to be awarded or any breach or alleged breach by the winner of any affirmation, undertaking or obligation under the Rules (including this Exhibit B). The winner further agree that in the event the winner brings a claim or lawsuit in violation of these terms and conditions, the winner shall be liable for any attorneys' fees and costs incurred by Released Entities in connection with such claim or lawsuit.
In addition, the winner agrees to and hereby releases on behalf of the winner's assigns, personal representatives and heirs, the Released Entities from and against all liability with respect to in any way arising out of the winner's tax liabilities and/or use of the winner's name, likeness, voice or any other material the winner submits for the participation in the Contest, including, but not limited to, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action, or otherwise in connection with or related to the Contest.
The winner accepts the Prize at the winner's own risk and takes sole and absolute responsibility for any injuries incurred out of the winner's participation in the Contest or the use of the Prize(s), including, without limitation, the risk of personal injury and/or death, and WILL NOT HOLD SPONSOR OR ANY OTHER RELEASED ENTITY RESPONSIBLE.
The winner understands that Sponsor is responsible only for Prize delivery; not responsible for Prize utility, quality or otherwise.
The winner understands that these terms and conditions are intended to be as broad and inclusive as permitted by law, and the winner agrees that if any portion of these terms and conditions are invalid, the remainder will continue in full force and effect. Furthermore, the winner fully understands these terms and conditions.
